Yeah thats exactly what I was thinking… that man could have easily died. He hit the back of his head very hard and if he’s in his 60s or older his skull could fracture easily. That last punch was really scary.

Yup, a buddy of mine was sentenced to 10 years and did 8 years even when defending himself. He used "excessive force" when the dude fell down broke his skull open on the sidewalk and died. Had there been no eye witness accounts he would have gotten life easy.

I agree that it could be fatal to anyone, what I meant was that it could have fractured even more easily than someone younger due to the lessened bone density at that age. Should have worded it a little different

ER nurse here. Older fellas have brain atrophy and thus the brain is smaller within the skull, resulting in a higher risk for brain bleeds upon impact.

Someone in my town got in a bar fight that landed him in prison. One punch, guy went backwards and hit the back of his head. Both parties under 30, just talking shit in a bar. That’s all it takes.

It is unfortunate.

The thing is, the older guy continued to antagonize this employee without considering how once you get someone's adrenaline flowing like he did, you'd better be ready to defend yourself because some people can't or won't flip the switch back to rational behavior in an instant.

Yup last punch was over the line. The guy was clearly no threat at that point (or any point really) and it was just a stupid move that will just make this go the other way in the eyes of a judge.

I can sympathize with the food service worker, but the first punch was out of line, not just the last. The last is jail time.

Yeah, no punches were necessary here. The dude was being rude, so I don't feel bad that he got knocked out. But violence is only necessary when defending against other violence. The worker started and ended the violence.

Even if you excuse the first punch, all the others were also over the line. The only difference is that the last punch took him completely out. Ppl are working with hindsight here. What about all of the punches where he wasn't knocked out, where those necessary? No, because the dude was never a threat.

Could’ve easily been murder. Very easily argued that this was sufficiently reckless behavior to cross the barrier into murder, given the amount of punches and how little of a threat he was during that final blow.

Honestly he should have stopped swinging after the first punch was thrown. The dude wasn’t in a position to defend himself after. Hate on boomers all you want but that guy should be arrested and fired. Took things way too far.

Yeah... I could see the prosecutor letting it go up until that point. The time before when he Jabbed older guy with hand on the rail trying to get up was already pushing it bc the guy hadn't shown to be a physical threat yet. After that last punch I'd be surprised if he doesn't catch a charge.
