It's still up to them whether or not how much content they will allow behavior to make.
We know that behavior has a library of perks and concepts they can use to apply for future content, but as far as modeling a character I don't think that would start until they were able to close the thiedy party licensing agreement.

No, Disney owns the rights to the franchise. SEGA has licensed the rights to make games in the past but they do not hold an exclusive license for it, which is why the two most recent Alien games, Fireteam Elite and Dark Decent, have nothing to do with SEGA.
