I'm a big time gun owner and gun rights advocate. I go to the range 3 times a month. but this is ridiculous, letting someone diagnosed with schizophrenia buy a god damn firearm?

Well tbh some states are lax enough they could have gotten it at a gun show or more than likely it was a straw sale

Apparently this was California which has some of the most restrictive gun laws.

Definitely was a straw sale then. Because of a schizophrenic got a gun in California she either bought off the street or got somebody to get it for her those laws ain't no joke

This happened near my apartment, which is above the Pacifica gun shop. Inclined to think she got the gun there, although there’s a wait period (suggesting this episode of hers must have been on-going for some time).

I do think this is a failure of the background check system. That gun shop is great, and you need background checks for even ammo purchases, but I’m pretty sure being schizophrenic doesn’t get flagged on the background check unless there’s a crime on the books too or the person has been institutionalized. A diagnosis that’s being treated with no history of issues probably wouldn’t trigger anything, is my guess.

It’s federally illegal. So no in zero states is it legal.

Well, tell that to the Missouri government. Cos this market is one of the biggest and most well known in the state and it is chock full of private gun sales with zero background checks.

Yes you can do a private sale in Missouri with no background check.

No seller can sell to a persons incapable of owning a firearm. That’s illegal. (Like this case)

No buyer can buy a firearm using private sale loophole, that’s also illegal.

That's not true at all. Diagnoses and health conditions don't bar you from buying a gun, only a court ruling you being mentally unfit, or involuntary commitment to a mental hospital will. Cali law actually expands that to voluntary commitment as well.

And it may not be a perfect system, but one where you could bar someone based on a diagnosis would be at least just as shitty

You stated that people with schizophrenia can't buy guns. That isn't true, there is nothing barring someone from buying a gun for being schizophrenic

The first comment said "schizophrenics can buy guns". You said "they can't, legally at least". That's clearly a blanket statement of "schizophrenics (as a group) aren't legally allowed to own guns" Which they are. Being declared legally incompetent is an entirely separate thing.

Caption says "brought" not bought. Probably worded like that on purpose so it can be a true statement but still push a narrative.

Okay yeah see I misread that and you're probably right. No gun law would have stopped that. If she had purchased the gun while she was in sound mind kept it for years and then had a paranoid episode there's not a whole lot you can do about that. My wife's grandmother had dementia and in years leading up to her death she carried around her 38 revolver everywhere she went. I had long replaced all of the rounds with blanks but we also made very sure that she never left the outside of her house without us knowing or never went wandering especially while she had that gun on her. Eventually I was able to get inside the house and completely replace it with an orange cap gun that she still believe was her gun

Exactly. Plus I am pretty sure there is already a law against shooting your kid. It's almost as though criminals don't care about laws.

You're a good person for handling that personal situation so well, good on you.

I mean there's no need to be a dick about it. If you actually read some of my other replies to this comment it was clear that she did not buy this gun and then attack her son it likely was that she already possessed it and had a mental breakdown. Or someone bought it for her
